The following is an Agreement between you and Dalton Paradise Carpet, Inc. ("DaltonCarpet.com") which governs the use of this web site and any web page which is a part of this web site and your purchase of any product or service through the use of this web site, including but not limited to products seen on the website and ordered via web, phone, or email.

ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.

Your use of this web site, including visiting any page which is a part of this web site, and your purchase of any product or service through the use of this web site constitute your acceptance of the terms and conditions of this Agreement. You understand and acknowledge that your use of this web site and your purchase of any product or service through the use of this web site are conditioned on your prior acceptance of the terms of this Agreement. You agree to use this web site solely in accordance and compliance with the terms of this Agreement.

THIS AGREEMENT CONTAINS DISCLAIMERS AND LIMITATIONS OF WARRANTIES AND LIABILITIES AND PROVISIONS REGARDING WHERE A LAWSUIT MAY BE BROUGHT.

ORDER CONFIRMATION

By accepting these terms and conditions, you are affirming that the order is correct and you agree to our terms and conditions.

SAMPLES
By submitting your payment via web or otherwise, you are agreeing to accept responsibility for payment. After they have been processed, packaged, and/or shipped it may not be cancelled and is non-refundable. Credit for carpet samples may be given when your carpet order is placed, with prior written approval for credit to be placed on order. We do not guarantee delivery times, but may offer estimated time frame.

STOCK AVAILABILITY

We can verify that a product is in stock, however stock can change hourly, and may not still be in stock at the time of your payment. In most instances, we offer to reserve a product for a twenty-four business hour hold to give you sufficient time to process your payment. However, we do not guarantee stock at any time.

PAYMENT POLICY

Most orders are required to be paid in full unless otherwise stated on your order confirmation. Most orders are paid by check or electronic bank transfer, and are required to clear before processing and/or shipping.

SHIPPING TIMELINES

Most in stock items will be shipped 24-48 business hours from time of cleared payment. However, these times may vary depending on Holidays, warehouse location, production times, etc. Our goal is to have your product inspected, properly packaged and shipped at the most early convenience. We do our best to give you proper estimated ship and delivery times upon order. We do not guarantee a specific ship time, transit time, or delivery time.

PRODUCT PHOTOS

Actual items may vary in color, texture, and/or pattern from eletronic appearance. Despite every effort to accurately duplicate each product, when scanned to our website color and actual pattern can appear different. Not all room scenes are an exact photo, some are a similar product. For these reasons we highly recommend that you order samples to view in the convenience of your own home and exact lighting.

FREIGHT AND DELIVERY POLICY

We use a large variety of reputable shipping companies to deliver our products. Each individual company have their own polices regarding dates, time frames, and requirements. Once your order has been shipped, we send you an email providing you with the bill of lading and phone number so that you may track your shipment with the carrier. We recommend that you contact your specific carrier in order to set up delivery. Most, but not all carriers may contact you, however they are not obligated. It is your responsibility to make arrangements for delivery and for any delivery to business, residence, limited access location (school, church, hotel, place of worship, etc), and any location you have your carpet delivered will require you to have adequate manpower and/or machinary to offload the material. If a shipment is required to be re-delivered for any reason, there will be charges accessed that is the end user's responsiblity to pay prior to re-delivery. Any freight returned to us, or change of destination will be customers’ responsibility, and will have additional fees.

FREE SHIP ITEMS

Each style has a minimum. Please contact us for details. Free Ship includes shipping to our nearest freight service center location for pick up, please contact us for the Service Center nearest you. Residential or delivery to specific locations may be requested at additional costs not included in the Free Ship program. Residential and other specific deliveries generally range, but are not limited to, an estimated $75-150. Pro-Rated shipping on orders that do not meet the minimum requirements to qualify for the program. Free Ship pad must be shipped with a carpet. Some exclusions apply. It is also subject to minimum requirements and same terms as stated in the paragraph above for the carpet style Free Ship program. Please contact us for details.

REFUND & RETURN POLICY

Upon the flooring order being placed and/or paid, all cancellations will be subject to a processing and/or restock fee. Certain sizes and products cannot be returned or cancelled, unless otherwise agreed upon or with a proper Return Authorization at the sole discretion of DaltonCarpet.com. Once carpet has been shipped, orders are subject to additional fees including, but not limited to, return shipping charges.

DEPOSITS

DaltonCarpet.com allows customers to pay deposits or in full to hold pricing for up to 4 weeks. In this event, should an order be cancelled after receipt of full payment, it is are subject to the cancellation, and/or restock fees of the product. As noted above, certian sizes and products cannot be returned or cancelled. Deposits to hold pricing and/or process are non refundable.

MANUFACTURER DEFECTS

Defects or damage must be reported within 15 days of receipt of goods.

MODIFICATIONS OF THIS AGREEMENT.

DaltonCarpet.com reserves the right, in its sole discretion, to modify and amend this Agreement in any manner at any time by posting a change notice or new agreement on DaltonCarpet.com. Your continued use of this web site and the purchase of any product or service through the use of this web site constitute your prior acceptance of the terms of such change notice or new agreement.

ADDITIONAL TERMS.

Certain features, functions, and sections of this web site and the purchase of products and services through the use of this web site may be subject to additional posted terms and conditions governing the use of such features, functions and sections and the purchase of such products and services. Such additional posted terms and conditions are expressly incorporated into and made a part of this Agreement. In addition, DaltonCarpet.com may establish guidelines, policies, and codes of conduct governing the use of this web site and all such posted guidelines, policies, and codes of conduct are expressly incorporated into and made a part of this Agreement.
